LEGAL PREAMBLE
This document constitutes the definitive, legally binding regulatory architecture governing all interactions, operations, and data transfers conducted through the ecosystem of MedStream Global (www.medstream.global). This comprehensive framework applies unconditionally to all subscribing corporate clients, healthcare providers, and entities, whether operating locally or internationally across global jurisdictions.
PART 1: TERMS & CONDITIONS
1. Acceptance of Terms & Institutional Licensing
By accessing, browsing, or utilizing the platform hosted at www.medstream.global, the user or corporate entity explicitly acknowledges and agrees to be bound by these Terms and Conditions and all applicable laws. If you do not agree, please cease using the site immediately.
MedStream Global grants the subscribing corporate entity (the “Client”) a non-exclusive, non-transferable, revocable institutional license to utilize its integrated digital ecosystem.
Users are strictly prohibited from copying, data scraping, or reverse-engineering platform algorithms. Any attempt to breach servers will result in immediate prosecution.
2. Infrastructure Disclaimer & Liability Separation
MedStream Global operates strictly as a digital infrastructure utility and a technological bridge. It is not a healthcare provider, law firm, educational institution, or independent logistics carrier.
While the platform provides the necessary digital tools and secure channels, the provider-patient relationship remains subject to the standard professional and clinical liability of the respective practitioner or facility. Consequently, subscribing members operate with full professional independence, without any joint liability on the platform for clinical outcomes or consultation insights.
3. Intellectual Property, Designs & Operations Protection
MedStream Global retains absolute and exclusive ownership over all source codes, software workflows, backend logic, trilingual infrastructures, UI/UX designs, images, text, logos, templates, and corporate policies.
Any copying, cloning, imprinting, or adoption of the platform’s visual identity, formats, corporate policies, or operational methodologies by users or third parties is legally defined as intellectual property theft and is strictly prohibited.
4. Patent & Industrial Property Protection Policy
All software modules, clinical algorithms, and supply-chain structures built within www.medstream.global are treated as protected industrial property under UAE Federal Law No. (11) of 2021.
Corporate entities, clinics, and individual providers are strictly barred from cloning, reverse-engineering, or mirroring the unique quadruple-integrated model of the platform.
5. External Links & Third-Party Services
The site may contain links to external third-party portals (e.g., payment gateways or logistics networks). MedStream Global assumes no liability for the content, privacy policies, or operational practices of external platforms.
6. Policy Amendments & Liability Caps
The platform reserves the absolute right to update or modify these Terms at any time without prior notice. Continued utilization of the portal implies irrevocable acceptance of the active, amended legal framework.
The absolute financial liability of MedStream Global for any technical malfunction shall never exceed the total net fees actually paid by the Client to the platform during the immediate six (6) month period preceding the claim.
7. Governing Law & Commercial Arbitration
This framework shall be governed, interpreted, and enforced strictly in accordance with the federal laws and regulations of the United Arab Emirates.
If unresolved amicably within 30 days, disputes shall be settled by binding commercial arbitration under the rules of the Commercial Arbitration Center within the city of the platform’s headquarters.
PART 2: PRIVACY POLICY & COOKIE POLICY
1. Advanced Data Processing Agreement (DPA)
The platform processes highly sensitive data, including clinical patient records, diagnostic profiles, legal contracts, academic histories, and logistical tracking data.
MedStream Global operates strictly as a Data Processor under the UAE Personal Data Protection Law (PDPL – Decree-Law No. 45 of 2021). The subscribing healthcare facility or individual provider acts as the sole Data Controller and retains legal responsibility for obtaining necessary patient consents.
MedStream Global operates under a zero-tolerance policy for healthcare data exposure. All medical data hosting and transit protocols are designed in absolute compliance with the UAE PDPL, HIPAA and GDPR.
2. Structural Cookie Policy & Optimization Trackers Cookies are small text files stored locally on your system terminal upon accessing www.medstream.global. These scripts accelerate browsing speed, stabilize user flows, and enhance portal security.
